What is an Occupation Right Agreement (ORA)?

It is important for intending residents of Rosebank Retirement Village to be fully aware of the nature of their occupation and ownership of their villa:

  • While residents occupy their villa under the ORA, the title to the land and buildings remain with the Rosebank Retirement Village Ltd.
  • An ORA gives residents the exclusive right to live in their home and enjoy the use of the village according to the terms of the contractual document.
  • The ORA does not carry any entitlement to capital gain on termination of the agreement.

The ORA is the most common form of occupation and ownership of villages in New Zealand. All villages are covered by the Retirement Villages Act (RVA) 2003 and its regulations. The act requires the appointment of a Statutory Supervisor whose role it is to protect the rights of the village, particularly so in the event ofthe Village Operator failing to honorits obligations underthe RVA 2033. Rosebank Retirement Village Ltd has appointed Anchorage Trustee Services as Statutory Supervisor.

der the RVA 2003 your Solicitor must fully explain to you the ORA, Disclosure Statement and Deed of Supervision. The ORA must be signed in your Solicitor’s presence.

What is the cooling off period?

Under the RVA 2003 there is a 15-day cooling off period after you have signed the documentation with your Solicitor. During this period, you can cancel your agreement without any deductions. You will eceive your deposit back with interest. You are unable to move into the village until at least 16 working days after signing the documentation with your Solicitor.

What payments do I make when I leave Rosebank Retirement Village?

Payments to take place on the termination of the Occupational Right Agreement:

  • The Village contribution – this finances Rosebank Retirement Village’s provision of the leisure facilities, and the maintenance costs not covered by the Village outgoings fee. It covers redecoration and refurbishment costs (see note below) and replacement of chattels within the dwelling and all costs related to reselling the villa. It is not payable in cash. It is a percentage of your original purchase price.
  • Note: Residents will be liable for the costs of repairing any damage to the interior of the dwelling (including chattels), which is not attributable to fair wear and tear.
What does the Village outgoings fee cover?

The Village outgoings is a weekly set fee, It covers:

  • Exterior building maintenance on your home;
  • Rates;
  • Building insurance – for both common facilities and your home;
  • Lighting to common areas, both inside and outside;
  • 24 hour security systems;
  • 24 hour emergency call systems;
  • Maintenance of all garden and lawns;
  • External maintenance of the village’s walls and security fencing;
  • Rubbish removal;
  • Administration and management;
  • Use and enjoyment of all Village amenities.

This amount is paid monthly in advance. It does not include:

  • Insurance on your furniture, clothes, appliances and personal belongings;
  • Utility costs (electricity & water);
  • Telephone charges.

Please ask what the current weekly fee is.

Can the Village outgoings fee change?

Yes. As you can see from above, the Village outgoings fee covers the costs of running the Rosebank Retirement Village.

During the initial stages of development, Rosebank Retirement Village Ltd subsidises the overall running of the Village. In the longer term it is expected that the retirement community will become self-sufficient in covering its costs. All budgets and expenditure are presented to the Statutory Supervisor before any increase can occur.

Who looks after the interest of the Residents?

Under the terms of the Occupational Right Agreement a Statutory Supervisor is appointed who represents the interests of the Residents. In addition, each retirement community forms its own Residents Committee that works with the management to ensure the community meets the needs of its residents. The Manager’s door is always open to discuss any issues or concerns you may have. Lastly, Rosebank Retirement Village Ltd is a member of the Retirement Villages Association which as a code of practice designed to protect the needs rights of residents.

Can I have my own garden?

You may request to tend the garden area directly around your villa. All costs involved for plants and materials will then become your responsibility. If you would like an extra section of garden for vegetable, then this can be discussed with the village manager.

If at any time the future you no longer wish to care for the garden area around your villa then it will be cared for by the village gardener.

What are the shopping and transport arrangements at the village?

The village has a courtesy van which makes weekly trips to the supermarket. The village activities programme may also include other outgoings in the van from time to time.

Is this a good location?
One of the most important considerations for Rosebank Retirement Village in choosing this site is to make sure they are centrally located. We believe that people want to “retire where the action is” and be able to continue to play an active part in a community – whether that be walking to the shops or the library or getting involved in local clubs.
Can I bequeath my Occupational Right Agreement to a family member?
No, the Occupational Right Agreement is not transferable.
Can a Family Trust purchase an Occupational Right Agreement?
The Occupational Right Agreement can only be issued in the names of the residents occupying the dwelling. However, the funds used to purchase the agreement can come from a Family Trust. In this case, a separate deed will be drawn up between the parties involved to legally identify where the funds came from, and where they are later to be distributed on termination of the agreement.
Is Rosebank Retirement Village safe and secure?
Your personal and general security is imperative to us. Security fencing, and strategically placed emergency call buttons, in each home are provided and monitored 24 hours per day.
Will my independence and privacy berespected?
Your independence is encouraged, but assistance is available if needed. You will live in a community of like-mined people – of similar age with lots of different personal situations and personalities. A large range of activities are available within Rosebank Retirement Village – which you can choose to be involved in if you wish. If, however you simply wish to choose the quiet privacy of your own home that is fine too. The choice is yours.
Can my family and friends come to stay?
Of course – this is your home. Your family, grandchildren and friends are welcome to stay with you for short periods of time (up to three months) but may not move in on a permanent basis without prior approval from the Manager. You may entertain your family and friends in your own home, or in the community centre, where your guests are more than welcome to use the common facilities, provided you are with them.
Am l able to have my pets living with me?
Your domestic pets, within reason, are very welcome to join you. The only limitation is the possibility that your pet could become a nuisance to others living at Rosebank Retirement Village and as a precaution to this; we will need to “meet” your pet beforehand. Approval is at the discretion of the Manager.
What happens when I go on holiday?
One of the great advantages of retirement communities is that there are always nice people to collect your mail, look after your home, and even water your plants. Whether you go away for o week or a few months, the management team will care for your home and gardens.
Who is responsible for insurance?
Rosebank Retirement Village Ltd insures the buildings (including carpets and floor coverings, drapes and fixed chattels). You are responsible for insuring your own contents and personal effects, as well as your private motor vehicle. You will also be responsible for the repair costs or excess on any insurance claims arising out of any willful or deliberate damage done by yourself or your guests to the dwelling, chattels or community buildings.
What happens if I have an accident or get sick?

If you have an accident and need immediate attention, simply press any one of the strategically placed emergency buttons in your home and response is immediate.

If your health deteriorates significantly, then our staff will work with you, your family and doctor to facilitate the required care within your home.

What if I want to redecorate my home – for example change the wall or floor coverings?

This can be done at your own cost, in consultation with and at the discretion of the Manager.

How do I go about owning a villa at Rosebank Retirement Village?

You will need to spend some time with the Manager, to ensure you understand Rosebank Retirement Village and the villa plans;

  • After you have selected the villa of your choice, you may take an option on this. We will hold this option for approx. 7 days after which time you would need to make a decision to proceed or not.
  • At this point you will need to meet again with the Manager to fill out all the relevan documentation which you will then take to your solicitor. Your solicitor will advise you and get you to sign the documents. The documents will then be returned to the Manager by yourself o in the post along with a $5,000 deposit. This deposit is paid to the Covenant Trustee Company Lto and your villa is secured.
  • After signing the Occupation Right Agreement, you have a cooling off period of 15 working days
    which enables you to cancel the agreement if you wish without giving a reason.
  • For your peace of mind, should you for any reason decide not to go ahead with your purchase,
    your deposit will be refunded to you in full plus any interest earned (interest at normal bank rates).
  • From this point on the Manager will work with you to determine the appropriate settlement dates
    for you to move into your villa, and for the settlement of funds to be paid. And before you know it – you too can be enjoying life at Rosebank Retirement Village.
The questions and answers above are provided for your convenience. Care Suites

Can I continue to receive my super?
Yes, since you’re living in your own care suite, you remain eligible for the living-alone allowance.
What happens to my home when I go on holiday?
While you’re away, whether for a short getaway or an extended holiday, we’ll take care of your home and garden. We just ask that you notify us of any extended absences or changes to your travel plans.
Can I rent or lease out my home?
No, your dwelling is exclusively for your and visitors’ use, as outlined in the Occupation Licence.
Is there a 24-hour emergency facility?
Yes, all homes are equipped with an emergency call system and smoke detectors, which are monitored 24/7.
Can I move in straight away?
You can move in immediately once your care suite is ready and the necessary legal documents are signed.
What other expenses will I be responsible for?
In addition to your weekly fee and any optional care services you select, you will be responsible for telephone, TV, contents insurance, and the interior maintenance of your home.
Who can I talk to if i have a concern?
If you have any worries or concerns, please speak with a member of our team or Rosebank Lifecare Management. We have a formal complaints procedure in place to ensure your concerns are addressed promptly. If you need further support, Covenant Trustee Services and the Retirement Villages Association are also available to assist. Your peace of mind is our priority.
Can I change my level of care and services?
Yes, absolutely. If your needs change, speak with our facility manager, who will work with you to adjust your care and services. Any additional support will be arranged immediately, ensuring you continue to receive the right level of care tailored to your preferences.
Do I benefit from capital gains or risk capital losses?
No, there are no capital gains or losses when you purchase a home with us. Instead of owning the property or land, you’re securing an Occupation Right Agreement (ORA), which grants you the right to live in your home for as long as you choose. When it’s time for a new resident to move in, we determine the price based on market conditions, so you won’t be affected by changes in property values.
Can I bring my own belongings to my care suite?
Yes! We encourage you to bring your own furniture, pictures, ornaments, rugs, pot plants, and other personal items to make your care suite feel like home. Your space should reflect your personality and comfort, so feel free to add those special touches that mean the most to you.
